Terms of Service
Establishing the ground rules for our partnership.
1. Acceptance of Terms
By accessing bitBrain's website or using our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Services
bitBrain provides custom software development, AI solutions, and digital strategy services. The specific scope of work for any project will be defined in a separate agreement.
3. Intellectual Property
Unless otherwise agreed in writing, all intellectual property created during the course of a project will be transferred to the client upon full payment of fees.
4. Payment Terms
For one-time projects, we require a 50% upfront payment before work begins. The remaining balance is split across project milestones as defined in your project proposal. Each milestone payment is due upon delivery and approval of that milestone's deliverables.
For monthly retainer or ongoing projects, the agreed monthly amount is payable in advance at the start of each billing cycle. This is because we reserve dedicated resources and hours exclusively for your project during that period. Late payments may result in suspension of services and release of reserved resources.
5. Limitation of Liability
bitBrain shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services.
6. Governing Law
These terms are governed by the laws of the jurisdiction in which bitBrain operates.
7. Updates to Terms
We may update these terms from time to time. Continued use of our services constitutes acceptance of the new terms.
